The issue of conscientious objection only came up briefly. The issue had been raised by War Resisters' International in a report to the Human Rights Committee. Regarding the issue of alternative service in lieu of military service and conscientious objection, the Committee asked if the delegation could inform it of the criteria used to determine approval for alternative service because the information provided in the report suggested that very few applicants were approved for alternative service.

According to the press release, the reply of the Estonian delegation was: "Turning to conscientious objection, the delegation said that one of the reasons that only 11 of 64 applications had been approved was that alternative service lasted longer than military service so many people eventually opted to go into the military. Also, the State had to be sure that people were truly conscientious objectors and not just saying that to get out of military service."

In its Concluding Observations, the Human Rights Committee said:
"14. The Committee is concerned that few applications for alternative to military service have been approved during the last few years (11 of 64 in 2007, 14 of 68 in 2008, 32 of 53 in 2009). It is also concerned about the lack of clear grounds for accepting or rejecting an application for alternative to military service (art. 18, 26).

The State party should clarify the grounds under which applications to alternative to military service are accepted or rejected and take relevant measures to ensure that the right of conscientious objection is upheld."

Sources: War Resisters' International: Country report and updates: Estonia, 23 October 2008; Human Rights Committee: Consideration of reports submitted by States parties under article 40 of the Covenant. Andreas Speck, Right to Refuse to Kill Programme, War Resisters' International

1. Introduction

In this presentation I
will give an overview of the right to conscientious objection, its
legal practices and frameworks in the 27 European Union member
states. Before I do so, I want to step back a bit and have a brief
look at the existing international standards about the right to
conscientious objection, as these standards allow us to put the
practices in the EU member states into a perspective.

► Conscientious objection as a right

It is now accepted that
the right to conscientious objection is protected under the right to
freedom of thought, conscience and religion (Article 18 International
Covenant on Civil and Political Rights, Article 9 of the European
Convention of Human Rights), and seen as a legitimate exercise of
this right1.
The former United Nations Commission on Human Rights has reiterated
this right in several resolutions since 19872.
If there have been any doubts in the past, then the decision of the
United Nations Human Rights Committee from January 2007 on two
individual complaints from South Korea certainly clarified the
issue3.
Subsequently, the United Nations Working Group on Arbitrary
Detention classified any imprisonment of a conscientious objector
as a form of arbitrary detention4,
while previously it only saw the second and any subsequent
imprisonment as arbitrary detention.

It is important to note
that article 18(1) of the Covenant, which covers both the right to
freedom of thought, conscience and religion and to manifest it, is
non-derogable even during times of national emergency threatening the
life of the nation.

While there has been
some jurisprudence at the level of the United Nations Human Rights
Committee, the European Court of Human Rights has so far
shied away from ruling on the question whether article 9 of the
European Convention of Human Rights includes the right to
conscientious objection5.
It is hard to imagine that following the Human Rights Committee
decision from 23 January 2007, the ECHR would not rule in a similar
manner to the Human Rights Committee in a future case.

Although the right to
conscientious objection is derived from the right to freedom of
thought, conscience and religion, it is clear that it is not limited
to religious convictions. According to the Human Rights Committee's
General Comment No 22, “article 18 protects theistic,
non-theistic and atheistic beliefs”. In fact, the Human Rights
Committee repeatedly recommended to States in its Concluding
Observations “extend the right of conscientious objection
against mandatory military service to persons who hold non-religious
beliefs grounded in conscience”6.

The question of
“selective” conscientious objection, not to war in general but to
a particular war, has not been dealt with very much. However, the
United Nations General Assembly, in its resolution 33/165 from 20
December 1978, recognised “the right of all persons to refuse
service in military or police forces which are used to enforce
apartheid”7.

It is also important to
note that it is not allowed to exclude groups of people from the
right to conscientious objection, for example for having a gun
license or other reasons.

► Right to conscientious objection at any time – before, during and after
service

Another important
aspect is when an application for conscientious objection can be
made. The general freedom to change one's religion or belief is
recognised in Article 18(1) of the Covenant. Thus, the Human Rights
Committee recognised in its Concluding Observations on Chile, that
“conscientious objection can occur at any time, even when
a person’s military service has already begun”8.
The Commission on Human Rights in its resolution 1998/77 highlighted
“that persons performing military service may develop
conscientious objections”9.
The European Parliament, in its resolution from 13 October 1989,
called “for the right to be granted to all conscripts at any
time to refuse military service, whether armed or unarmed, on grounds
of conscience”10.
In its 1994 resolution, the European Parliament explicitly called “on
the Member States of the European Union which do not have (or no
longer have) conscription and military and civilian service
nevertheless to guarantee the fundamental right of conscientious
objection”11.

Council of Europe
Parliamentary Assembly Recommendation 1518 (2001) explicitly
recognised “the right to be registered as a conscientious
objector at any time: before, during or after conscription, or
performance of military service” and “the right for
permanent members of the armed forces to apply for the granting of
conscientious objector status”12.
The Parliamentary Assembly also demanded from member states on 24
March 2006 in a decision on human rights in the Armed Forces to
“introduce into their legislation the right to be registered as
a conscientious objector at any time, namely before, during or after
implementation of military service, as well as the right of career
servicemen to obtain the status of conscientious objector”13.

► Impartial decision making procedure

The United Nations
Commission on Human Rights has welcomed “the fact that some
States accept claims of conscientious objection as valid without
inquiry”, and called for “independent and impartial
decision-making bodies” where this is not the case14.
More concretely, it has expressed its concern that “the
assessment of applications for such service is solely under the
control of the Ministry of Defence”. It therefore recommended
“placing the assessment of applications for conscientious
objector status under the control of civilian authorities”15.

► Non-punitive substitute service

It first has to be
noted that there does not have to be a substitute service. However,
if a state decides to require a substitute service from conscientious
objectors, then this substitute service has to be compatible with the
reasons for the conscientious objection, of civilian character, in
the public interest and not of a punitive nature. The term “punitive”
covers not only the duration of substitute service, but also the type
of service and the conditions under which it is served.

In terms of length of
substitute service, the United Nations Human Rights Committee has
made clear in Foin v. France that any difference in length
must be “based on reasonable and objective criteria, such as the
nature of the specific service concerned, or the need for a special
training in order to accomplish that service”16.
This means that any general difference in length, as is the practice
in many countries, is not permitted.

► Provision of information

It
is obvious that the provision of information about a right is crucial
for people to make use of that right. Therefore, the United Nations
Commission on Human Rights affirmed in its resolution 1998/77 “the
importance of the availability of information about the right to
conscientious objection to military service, and the means of
acquiring conscientious objector status, to all persons affected by
military service”17.

Council
of Europe Recommendation No. R (87) 8 says that “persons liable
to conscription shall be informed in advance of their rights. For
this purpose, the state shall provide them with all relevant
information directly or allow private organizations concerned to
furnish that information”18.

2. Practice in European Union member states

From the 27 European
Union member states, 10 presently maintain conscription, although of
these two – Poland and Sweden – are presently in the process of
suspending conscription. However, most countries that did have
conscription in the recent past did not just abolish it, but mainly
suspended to enforce conscription. In most cases these countries
maintain laws and regulations which allow to enforce conscription
under certain circumstances, i.e. in situations of war or an
emergency.

Presently, all
countries of the European Union that maintain conscription do provide
for the right to conscientious objection in some form. However, this
does not mean that this would comply with the international standards
set out in the introduction.

Table 1: Overview:
conscription and the right to conscientious objection in the European
Union

<colgroup><col width="170" /><col width="125" /><col width="114" /><col width="128" /><col width="153" /></colgroup>

<td style="border-top: 1px solid #000000; service - especially in the cases of Greece and Finland. In recent years, it has taken up the issue on its own in several conclusions on country reports. We publish the relevant parts below (thanks go to the European Buereau for Conscientious Objection):

Estonia

"The Committee previously noted that legislation provided for alternative service to compulsory military service, but sought further clarification on the length of such alternative service. In December 2004 the length of alternative service was reduced to between 12 months (minimum) and 18 months (maximum) and is (according to other sources1) currently set at 16 months duration. Military service lasts between eight months (minimum) and 11 months (maximum).

The Committee recalls that under Article 1§ 2 the duration of alternative service may not exceed one and half times the length of military service. The Committee notes that according to the information available to it alternative service may amount to double the length of military service. The situation is therefore not in conformity with the Revised Charter on this point."

Finland

"Under the Military Service Act the length of military service is either 180, 270 or 362 days. According to the report the majority of conscripts perform at least 270 days (52.3 %) and 47.7 % perform 180 days. The duration of unarmed military service is 330 days and alternative civilian service 395 days.

The Committee has previously found that the situation is not in conformity with the Revised Charter on the grounds that the length of alternative service was more than double the length of compulsory service performed by the majority of conscripts (at that time 64,2 % of conscripts performed 180 days of military service. Although the situation has altered slightly during the reference period ,(see above), the Committee notes that it has only altered slightly and that the length of civilian service remains more that double the minimum period of military service which is under taken by almost half of all conscripts.

Therefore the Committee maintains that the length of alternative civilian service remains a disproportionate restriction on a worker’s right to earn a living in an occupation freely entered upon."

It has to be noted that since this conclusion has been published, Finland reduced the length of substitute service, but not sufficiently. The service has been shorted to 11 month from 1 January 2008 on.

Greece

"Since the case of Quaker Council of European Affairs v. Greece Complaint No. 8/2000 decision on the merits 25 April 2001 Greece has been found to be in breach of Article 1§ 2 on the grounds that the length of service alternative to military service is excessive. The legal regulations governing alternative military service have been amended over the years, although in its previous conclusion the Committee noted that the length of alternative service was still excessive in that it usually represented more than double the length of compulsory military service.

New legislation on this issue has again been introduced during the reference period; those who serve alternative civilian service instead of the average military service (or unarmed military service) are now liable to serve 23 months, instead of 30 months as was set previously (those who serve reduced armed service of nine months are now liable for 17 months instead of 25; those who serve reduced armed service of six months are now liable for 11 months instead of 20 and those who serve reduced armed service of five months are now liable for 3 months instead of 15). The length of full-armed military service is set at twelve months.

The Committee notes that the new legislation provide for a significant reduction in the length of alternative service; however it recalls that under Article 1§ 2 the duration of alternative service may not exceed one and half times the length of military service and consequently the situation in Greece can not be considered as being in conformity with Article 1§ 2 of the Charter."

Moldova

"According to the report the length of alternative service is 24 months, while the length of military service is 12 months.

The Committee recalls that under Article 1§ 2 the duration of alternative service may not exceed one and a half times the length of military service.
